Overview

Willms & Shier advises resources clients on

  • Environmental Assessments & Approvals,
  • Challenging & Appealing Government Decisions,
  • Defence of Prosecutions,
  • Forest Management Plans, and
  • Negotiating impact agreements between resource companies and affected local communities and First Nations

Our lawyers guide clients through the environmental assessment legal process for projects across Canada to ensure successful completion of the approval process.

We have successfully negotiated adaptive management plan agreements with neighbours. We have both negotiated and facilitated impact benefit agreements with aboriginal people. These agreements may incorporate solutions to mitigate potential adverse effects or to provide for payment of royalties to first nations people.

We negotiate with regulators to find positive solutions when our clients are faced prosecutions and orders related to mining and forestry activities. Where we cannot achieve a negotiated solution, we launch appeals of orders, judicial reviews of government decisions or vigorous defences to charges.
