Accordingly, estate trustees need to understand these potential environmental risks and liabilities, and how to manage them in carrying out their duties to protect both the estate trustee and the beneficiaries.
Under the Environmental Protection Act and the Ontario Water Resources Act, estate trustees and fiduciaries are afforded certain protections. With some forethought about activities carried out by estate trustees and deliberate drafting, estate trustees and beneficiaries can manage personal environmental liability.
