Our third webinar of the year is titled: Managing Environmental Risks and Liabilities for Estate Trustees. The webinar will take place on Wednesday, March 23, 2022 from 12:00 pm to 1:00 pm via Zoom.

Estates may include assets such as contaminated property owned personally by the deceased or businesses interests with ongoing or legacy contamination concerns. Estate trustees and beneficiaries can be exposed to personal environmental liability for these assets, including regulatory Orders and civil litigation. Accordingly, estate trustees need to understand these potential environmental risks and liabilities, and how to manage them in carrying out their duties to protect both the estate trustee and the beneficiaries.

Under the Environmental Protection Act and the Ontario Water Resources Act, estate trustees and fiduciaries are afforded certain protections. With some forethought about activities carried out by estate trustees and deliberate drafting, estate trustees and beneficiaries can manage personal environmental liability.
