2016 Nunavut Mining Symposium: Double Bonding - A Continuing Barrier to Development?

Charles Birchall will be speaking at The 2016 Nunavut Mining Symposium. The program is being held in Iqaluit, Nunavut between April 4-7, 2016.

Charles will be presenting on: Double Bonding - A Continuing Barrier to Development?

His presentation will focus on the amendment of the Nunavut Waters and Nunavut Surface Rights Tribunal Act ("NWNSRTA").

Bill S-6 passed on June 18, 2015 amending the Nunavut Waters and Nunavut Surface Rights Tribunal Act ("NWNSRTA") to address security for mine closure and reclamation and thus resolve the problem of double bonding.  A new section 76.1 was added to the legislation to allow for written arrangements to address security among the licence applicant, Canada and the Inuit Land Owner.

What are these new provisions and have they worked?

This presentation will provide an objective and critical analysis of the new legislative provision and its potential effectiveness. It will address the regulatory context which has led to double bonding and offer suggestions for making s.76.1 work and describe an alternative approach to resolving double bonding without the need for government involvement.
