OBA: Developments in D&O Liability for Environmental Contamination

John Georgakopoulos will be speaking at and Joanna Vince will be chairing the Ontario Bar Association's upcoming event "Developments in D&O Liability for Environmental Contamination".

Directors and officers face increasing personal exposure for environmental liability. They need to understand their exposure and how they can mitigate the risk of liability for environmental contamination.

The Ministry of the Environment has started looking to directors and officers to pay remediation costs where a company has stopped operating or has gone bankrupt. In the recent case, Baker et al. v. Director, Ministry of the Environment ("Baker"), the directors and officers settled a Ministry Order for $4.75 million. The directors and officers were required to pay the settlement personally.

This event will discuss:

  • The potential environmental liabilities for directors and officers of natural resources and energy companies
  • how to manage environmental liabilities and steps to minimize the risk
  • What insurance is (and is not) available for environmental liability for companies and directors and officers
